Avoiding Cost and Price Analysis Pitfalls in Source Selection

In recent years, a significant number of sustained bid protests have concerned cost or price realism analysis problems. We’ll discuss key lessons learned from these protests, and how procurement officers and contractors can avoid these same pitfalls.

Topics will include:

  • What magic words in a fixed-price RFP require/permit the agency to conduct a price realism analysis,
  • When it’s inappropriate to use government estimates and other proposals to conduct a price/cost realism analysis,
  • When cost realism adjustments are appropriate and inappropriate,
  • Pitfalls in establishing the realism of proposed exempt labor wage rates, and
  • Limits on using the results of a price/cost realism analysis in the source selection decision.

Adam K. Lasky is a partner at Oles Morrison Rinker & Baker LLP, where he focuses his legal practice on helping clients win government contracts. He has extensive experience litigating bid and size protests and has prevailed in multiple protests before the U.S. Court of Federal Claims, GAO, and the SBA. In addition, he regularly advises clients on how to make their proposals more competitive for contract awards, and on a variety of contract administration and claims issues. Lasky has written numerous articles and chapters on government contracts, including “A Practitioner’s Road Map to GAO Bid Protests” (The Construction Lawyer) and the bid protests chapter of “Federal Government Construction Contracts” (2d ed.). He is also the editor of Oles Morrison’s government contracts blog, The Procurement Playbook (www.procurementplaybook.com). Lasky has been recognized as a “Rising Star” in government contracts by Washington Super Lawyers in each of the past three years.

Laurie Davis began her contracting career in 2003 with the U.S. Navy, and is currently a supervisory contracting officer with the Naval Sea Systems Command.  Her education includes a BS in business finance from Oregon State University, an MBA from Pacific Lutheran University, and a Master’s Certificate in Contract Management from George Washington University. She holds two NCMA certifications, and currently serves as the president of NCMA’s West Sound Chapter.
