Enforceable Federal EEO Settlement Agreements: From Crafting to Drafting



Both the EEOC and the courts are pushing case settlements, so now is the time to get essential training on addressing settlements in a proactive, productive manner — and avoid having to defend a challenged agreement.

 

Attorney Joseph Kaplan will show you how to recognize when settling a particular EEO complaint can be in the best interest of the agency. Then, he’ll teach you how to avoid mistakes that lead to settlement terms being unlawful, insufficient or difficult to enforce, as he takes you through the process of drafting fail-proof agreements:

 

  • Identifying the elements of a settlement agreement that are necessary for it to be valid and enforceable.
  • Recognizing language or provisions that could lead to a settlement being found invalid and eliminating vague terms that can void the agreement
  • Including terms so an agreement can be salvaged even if one provision is breached

Joseph V. Kaplan, a founding principal of Passman & Kaplan, practices in the areas of employment, labor, and discrimination law.
