Forced labor in North American supply chains has emerged as a major issue for importers to include as part of their compliance programs. This is attributable to the USMCA’s absolute prohibition against the importation of goods made with forced labor and the subsequent actions taken by USMCA parties to introduce forced-labor-related compliance and enforcement mechanisms. Notwithstanding these positive legal and regulatory developments, the presumptions, procedures, and enforcement dynamics that characterize U.S., Mexican, and Canadian forced labor practices are quite disparate. The uncertainty that flows from this evolving situation can introduce compliance and enforcement risks for North American importers and exporters.

Speaker and Presenter Information

Dan Kiselbach is a partner at the Canadian law firm of Miller Thomson, LLP. Dan provides general legal counsel, and his practice focus is on global trade and tax. Over the last three decades, he has appeared at all Canadian court levels, including the superior courts of several provinces, the Tax Court of Canada, the Canadian International Trade Tribunal, the Federal Court of Canada, and the Supreme Court of Canada. He has represented clients in audit, assessment, enforcement, collections, criminal, and other matters, including London Court of International Arbitration proceedings. He is the Managing Partner of the Vancouver office, and also leads the firm’s Global Trade and Customs Group as well as the Vancouver Tax Group.

Dan provides legal, strategic, and planning advice. He frequently deals with anti-money-laundering and terrorist financing legislation, customs and commodity tax planning, e-commerce, economic sanctions, export controls, logistics, and supply chain management. He is a member of the bars of British Columbia, Ontario, and New York, and has extensive knowledge of the regulations affecting Canada-U.S. trade and investment.

 

 

 

Robert Kossick is a Board-Certified International Attorney, Licensed Customs Broker, and Certified Export Specialist whose practice focuses on the planning, compliance, enforcement, and security dimensions of U.S. import and export transactions. With more than 20 years of professional experience split between the U.S. and Latin America, Robert brings seasoned, specialized, and multicultural know-how and perspective to the analysis and resolution of customs and trade issues.

Robert has, over the course of his legal career, practiced customs and trade law with a Fortune 50 corporation, worked as a foreign legal consultant in Mexico, served as a trade policy analyst under former U.S. Trade Representative William Brock, and provided trade consulting/advisory services for the World Bank, the U.S. Agency for International Development, and the Washington District Export Council. Robert currently works as a Senior Trade Advisor with A.N. Deringer.

 

 

 

Luis F. Martinez has been advising clients for more than 25 years. His practice covers international trade, foreign investment, customs, import and export controls, compliance with non-tariff restrictions, customs litigation, unfair trade practices, export programs, and value-added tax, among other specialized topics.

Before going into private practice, Luis worked as a legal researcher on international trade, investment, and customs matters at the University of Arizona and at Tec de Monterrey. He received his law degree at Tec de Monterrey in 1997 and his LLM in International Trade Law from the University of Arizona in 1999. He is the former Mexico Chair of the U.S.-Mexico Bar Association and a board member of the American Chamber of Commerce, Monterrey Chapter, where he is currently the Chair of the Trade and Logistics Committee.
