Asia Pacific Export Controls 2014: Update and Tech Transfer Licensing

The “Year of the Horse” is here, and with it an ideal time to look at several key changes and new developments in Asia Pacific export controls from the last year, especially in the area of technology transfer licensing. 

Many of these important changes may have gone unnoticed while most have been focused on export control reform (ECR) initiatives in other parts of the world.  From special North Korea sanction implementation measures in China, to advance export declaration requirements in Singapore, to updated control lists in Taiwan, changes in export controls were visible across the region over the last year, and the pace of development is likely to increase in the year ahead.  One of the most critical and evolving areas of APAC export controls has been (and continues to be) licensing requirements for transfers of controlled technology.  From changes to cloud computing rules in Japan, to modified intangible transfer regulations in Korea, to the technology transfer requirements put forth in the Philippines’ latest draft export control bill, licensing transfers of controlled technology is reaching full-stride in the Asia Pacific.

This webinar has two main aims: 1) provide an update on the export control systems of key Asia Pacific economies, and 2) delve into a more detailed review of the rules and requirements for transfers of controlled technology in APAC.  The webinar will cover APAC export control updates and technology transfer controls as they pertain to all industry sectors, including the aerospace, automotive, biotechnology, chemical, defense, electronics, industrial equipment, information technology, and software industries.  In so doing, the export and technology transfer controls of Australia, China, Japan, Korea, Malaysia, Philippines, Singapore, Taiwan and other countries in the broader region will be discussed.  Specifically, this webinar will:

  • Deliver a comprehensive overview of the key export control-related developments in the Asia Pacific from the last year;
  • Highlight the implications of the changes and trends in APAC export controls for businesses currently (or hoping to be) active in the broader region;
  • Reveal the differences and similarities in how key countries in the Asia Pacific define and classify “controlled technology” and “technical assistance” (with comparisons to U.S. and EU definitions);
  • Address the application of various APAC country export controls to hand-carries, uploads, and oral transmissions of technology;
  • Explain the licensing procedures and documentation requirements for “exports” of controlled technology from APAC countries; and,
  • Note the potential penalties for noncompliance and if they can be mitigated through self-disclosure.
