U.S. concerns about Iran’s nuclear program have driven recent efforts to increase the sanctions placed on Iran.   The comprehensive Iranian sanctions of 2010 were followed by new sanctions at the end of 2011.  The February 5, 2012 Executive Order and February 27th implementing regulations have provided important clarifications as to the operations of these new provisions.  Serious efforts are underway in Congress to further increase sanctions on Iran and it is expected that at least some of these measures may pass. 

The breadth and reach of the Iranian sanctions provisions is unprecedented in many respects.   Not only do they provide for broad-reaching sanctions on U.S. and foreign entities engaged in prohibited activity and foreign financial institutions that do business with Iranian banks, but they enlist U.S. financial institutions in the enforcement efforts. 

These new sanctions provisions, layered on top of existing Iranian sanctions, present a somewhat confusing patchwork of laws and regulations.  This program will explain the operation and relationship of the various Iranian sanctions provisions, and address:

  • How could these sanctions impact your U.S. and foreign operations? 
  • What changes to your business operations should you make to comply with these provisions?
  • What can and should your company do to protect against costly investigations and possible penalties?
  • What activities may be subject to sanctions in the future?

Amanda DeBusk Partner - Hughes Hubbard & Reed LLP debusk@hugheshubbard.com Amanda DeBusk is the chair of Hughes Hubbard’s International Trade Department, where she heads the firm’s export controls and sanctions practice, and serves on the firm’s Executive Committee. She has a broad practice advising on U.S. international trade regulations that govern imports, exports, and trade compliance. She is a widely recognized authority in the enforcement of export controls and sanctions, drawing on her background as the former U.S. Commerce Department Assistant Secretary for Export Enforcement to handle civil and criminal enforcement matters and voluntary disclosures.
