Intellectual Property Rules in Government Contracts Legal Update: Know Your Technical Data and Patent Rights

There are a myriad of unique rules and regulations governing the rights to intellectual property in U.S. Government contracting. These rules and regulations are designed toadvance U.S. Government procurement policy considerations while, at the same time, balancing the contractor’s contribution in developing its intellectual property with the U.S. Government’s incremental investment. Because comparatively innocent mistakes can result in catastrophic waivers of valuable intellectual property rights, it is imperativefor contractors to understand and to steer through and around rules to maximize theprotection of their intellectual property rights.

This 90-minute webinar will provide an overview of the key principles governing therules and regulations relating to rights in technical data, computer software, and patents. This will include a discussion of recent and impending changes to these rules, particularly as the relate to commercial items and major weapons systems. With this background, the webinar will also provide practical pointers to help contractors avoid traps for the unwary that could inadvertently compromise of their intellectual property rights.

Speaker and Presenter Information

John E. McCarthy, Jr. is a partner in Crowell & Moring LLP’s Government Contracts Group. John focuses on a wide range of government procurement law, with a particular emphasis on technology-related issues. John has litigated and provided counseling on issues including patent and data rights, bid protests and other contract formation issues, contract claims, prime/sub disputes, socioeconomic issues, and false claim matters. John is a Vice-Chair of the American Bar Association’s Public Contract Law Section, Intellectual Property Committee, and has written and spoken extensively on government contracts technology issues and intellectual property rights. John has a master’s degree in electrical engineering, and prior to joining Crowell & Moring LLP, worked for ten years designing and developing computer and communication systems for various government contractors. Margaret (“Meg”) Nielsen is an associate in Crowell & Moring’s Government Contracts and E-Discovery and Information Management groups. Her practice includes counseling clients on a wide-range of government contracts regulatory and compliance issues, including internal and government investigations, data rights, and suspension and debarment issues, as well as representing clients in bid protests before the Government Accountability Office (GAO) and the Court of Federal Claims. Her practice also includes counseling clients on e-discovery related issues in government investigations.
