Understanding the Authority of Agency Officials: Don't Get Caught Holding the Bag

A thorough understanding of the authority and roles of government agency contracting officials can determine whether your company falls victim to mission creep, bid mistakes, improper agency actions or is able to draw a line in the sand. With the sequester providing unprecedented budget pressure, agency officials are getting more and more creative – sometimes stepping outside their authority. The purpose of this webinar is to help you understand the options your company may have if you are faced with a situation where an official who may not have authority directs the company to take actions; or where an official who does have authority engages in conduct that’s improper.

The 90-minute live webinar will highlight important red flags so that companies don’t leave money on the table when faced with questions about an agency official’s “authority,” and will include a discussion of “hot topics” in authority such as “de fact debarment” and agency budget problems. In addition, a 10-15 minute live Q&A period will be set aside at the end of the webinar so participants can ask their specific questions.

Learning Objectives

  • Identify where agency officials’ authority comes from, and the limits of that authority.
  • Discover what options your company may have if it follows directions from an agency official who lacked proper authority.
  • Formulating strategies for addressing issues of authority.
  • Examining issues of authority in specific situations, including: contract set-asides; bid protests; change orders; and claims issues.
  • Highlighting hot topics in authority such as “de facto debarment” and agency budget problems.
  • And much more!
Who Will Benefit

Any company that contracts with federal government agencies will benefit from gaining a deeper understanding of which agency officials are authorized to direct their contract performance, and knowing the limits of official authority in bid mistakes, claims, suspension and debarment, and set-aside decisions.
