Understanding the New ITAR Brokering Regulations

New brokering rules go into effect October 25, 2013.

In the midst of all the understandable attention regarding export control reform, the Directorate of Defense Trade Controls has published the first major overhaul of the ITAR's brokering rules since they originally went into effect in 1997. In this webinar, Scott Gearity of the Export Compliance Training Institute tackles the revised ITAR Part 129 with step-by-step guidance to help you determine if and how the new rules apply to you or your business partners.

Congress amended the Arms Export Control Act in 1996 to give the Department of State the authority to regulate arms brokering. Though Congress's action was driven largely by concerns about actions by U.S. nationals to further the global small arms bazaar, State's Directorate of Defense Trade Controls issued extremely broad regulations affecting both U.S. and foreign persons, as well as a wide range of military commodities, without advance notice or public comment. Ever since, the many parties affected by these rules have struggled to understand and comply. The revised regulations go some way to rectifying the problematic original rules, but still require careful consideration.
