Don’t Be RWA’ed: Get Your Licensing Right the First Time

Export control reform has altered the licensing landscape for all of us.  With the transition of many items and related technical information from the ITAR to the EAR, items which previously required a license from the State Department may now require a license from the Department of Commerce.  Or, you may need to alter the information you present in your State Department license application.

In this webinar, we will provide some practical tips related to licensing.  In particular, we will focus on licensing considerations arising out of export control reform, including:

  • Determining if a license is required or if a license exception may apply

  • Determining to which agency to apply for a license

  • Determining what documents to submit with your license application

  • Determining how to handle current licenses that include transitioning items

  • Determining how to approach applying for licenses for items which have not yet transitioned

We will also cover these topics:

  • Background on ITAR/EAR Licensing

  • Export Control Reform

    • 500/600 series ECCNs

    • (x) paragraph in the USML

  • Licensing Considerations Arising Out of Export Control Reform

    • Is a license required or does an exception apply?

    • To which agency should I apply for a license?

    • What supporting documentation should be provided with my license application?

    • What happens to my current licenses?

    • What should I do for items which have not yet transitioned?

This webinar will provide PowerPoint slides and include live video and commentary from Susan Kovarovics and Megan Gajewsk, who counsel foreign and domestic parties regarding international business regulatory matters. Webinar participants are invited to submit questions during the webinar; the final 30 minutes of the webinar will be allotted to answering attendees' questions.
