Terminations for Default

While contractors never begin performance thinking the contract will result in a termination for default, circumstances sometimes go this route.  A termination for default can be devastating to a government contractor in terms of damages and past performance.  Contractor’s should understand the applicable termination for default procedures and the options available to contest the termination.  This webinar will help Contractors learn how to: (a) reduce exposure to financial losses under the subject contract; (b) understand how to effectively contest the default termination; and (c) reduce the impact of the default termination on future Government Contract opportunities.

  • Overview of the FAR termination clauses;
  • Grounds for default terminations;
  • Procedures after receiving a notice of default termination;
  • Conversion to convenience termination; and
  • Excess reprocurement costs.

Gunjan R. Talati
Senior Counsel, Thompson Hine LLP

Gunjan is senior counsel in the firm’s Construction practice. His practice focuses on all aspects of government contract law, including the procurement process, small business matters, suspension and debarment, ethics and compliance, bid protests and claims. Gunjan has significant experience in helping contractors navigate the government contracts regulatory framework. As part of his practice, he has helped contractors of all sizes through contentious suspension and debarment proceedings before multiple agencies including the U.S. Air Force, the General Services Administration, the U.S. Army and the U.S. Agency for International Development. He was recognized by the National Law Journal as a 40 under 40 D.C. Rising Star for his suspension and debarment experience.

Dan is an associate in the firm's Construction group. His past experience includes handling a variety of construction, suretyship and government contract matters, including cases involving public and private construction disputes. Prior to practicing law, Dan served as a scheduling consultant for a DC-based consulting firm and as project engineer for a national construction contracting firm.
