Asia Pacific Export Controls: Updates and Export Facilitation Measures



2016 has been an active year in Asia Pacific (APAC) export controls and 2017 will continue that trend.  From control list changes across the region to the Philippines’ making progress on their strategic trade control Implementing Rules and Regulations (IRR) to China’s implementation of the JCPOA and North Korea's sanction-based export controls, 2016 has seen significant advancements in APAC export controls.  In 2017, we can expect to see the Philippines commence its export control system implementation, Thailand complete preparations for its own system launch on January 1, 2018, and the possibility of export control-related legal-regulatory developments in APAC economies such as Cambodia, Indonesia, and Mongolia.  Notwithstanding the continued expansion of export controls in APAC, several areas remain underdeveloped and/or not well-known to those doing business in and with the region.  One of the more obscure areas of APAC export control continues to be the export facilitation measures, such as license exceptions, general licenses, and compliant trader schemes, available in APAC systems.  Such facilitation measures, which sometimes serve as the salvation of export controls in the United States (U.S.) and European Union (EU) systems, are harder to find and/or make use of in APAC export control systems.  Thus, there may be times when an export that could go license free from the U.S. or EU would require a license if exported from Hong Kong, Japan, or Malaysia, which has been a source of confusion and compliance failures for those operating in APAC countries.  But the facilitation measures are there—from Australia’s “AUSGELs” to Singapore’s “Bulk Permits” to Taiwan’s “ICP Companies”—and knowing where they are, how to take advantage of them, and what the cost and other considerations are for using such measures, can save you time, money, and compliance headaches.

 

This webinar is intended to help companies in the electronics, industrial manufacturing, logistics, IT, aerospace, chemical, energy, and bio-tech sectors understand the changes that are taking place in APAC export controls, and provide valuable insight on what the availability and advantages of license exceptions, general licenses, and compliant trader programs are among APAC export control systems.  This webinar has been designed with APAC regional compliance teams and personnel responsible for covering multiple APAC countries and jurisdictions in-mind.  Specifically, this webinar will:

 

  • Deliver a comprehensive overview of the key export control-related developments in the Asia Pacific in 2016 and a look ahead to 2017 for Australia, Cambodia, China, Hong Kong, Indonesia, Japan, Korea, Malaysia, Myanmar, Mongolia, Philippines, Singapore, Thailand, and Taiwan;

  • Provide a thorough review of the updates to the export control lists of China, Japan, Korea, Singapore, and Taiwan and how they compare to other APAC system control lists and those of the U.S. and EU;

  • Identify and explain the type, scope, requirements, and advantages/disadvantages of all license exceptions, general licenses, and compliant trader programs available in APAC export control systems;

  • Offer practical tips on applying for—and remaining in compliance with—export control facilitation measures in APAC countries that offer them; and,

  • Include URLs and links to current copies of all the updated export control lists, regulations, and many of the forms discussed during the webinar.

This webinar will provide PowerPoint slides and include live video and commentary from Jay Nash who specializes in non-US trade controls and compliance. Mr. Nash has worked with national governments from every region of the world to provide guidance and support on establishing domestic export control systems, and developing compliance tools and resources for industry.  Mr. Nash is a regular speaker and presenter at regional and international export control conferences, and he has published on East Asian trade control developments in the US, Japan, and Korea. Webinar participants are invited to submit questions during the webinar; the final 30 minutes of the webinar will be allotted to answering attendees' questions.

Jay Nash

Managing Director for Strategy and Development / Asia Pacific expert - SECURUS Strategic Trade Solutions

Jay P. Nash is a co-founder, Managing Director for Strategy and Development, and Asia Pacific expert at SECURUS Strategic Trade Solutions, LLC, a consultancy that specializes in non-US trade controls and compliance. 

Prior to helping start SECURUS, Mr. Nash worked for five years as a Senior Associate and East Asia Projects Manager at the Center for International Trade and Security, University of Georgia (CITS/UGA), where he worked with both industry and government on a variety trade control matters.  He has helped companies in the aviation, telecommunications, automotive, chemical, and industrial equipment sectors track and operationalize trade control developments in mainland China, Hong Kong SAR, Taiwan, Japan, Korea, Singapore and other ASEAN countries.  He has also reviewed and helped enhance company internal compliance programs (ICP) and provided on-site export control training for company personnel.  In the public sector, Mr. Nash has worked with national governments from every region of the world to provide guidance and support on establishing domestic export control systems, and developing compliance tools and resources for industry.  Mr. Nash is a regular speaker and presenter at regional and international export control conferences, and he has published on East Asian trade control developments in the US, Japan, and Korea.  During his time at CITS/UGA, Mr. Nash lived and worked in Beijing, China for more than one year, and he is proficient in Mandarin Chinese.
