From Hand-Carries to the Cloud: Global Technology (and Software) Export Controls

From the introduction to controls on the “supply” of strategic technology in Australia, to the technology transfer restrictions proposed in Thailand’s draft weapons of mass destruction (WMD) act, to special (non-strategic) controls that many countries apply to imports and exports of encryption, even if you’re not in the IT or telecommunications sectors, there is a good chance that technology (and software) trade controls somewhere in the world affect your business.  Some countries’ technology trade controls extend from hand-carries all the way to the cloud, and to transfers abroad as well as to domestic transfers to foreign nationals. National governments from Latin America to the Middle East to East Asia are looking at ways and making efforts to enforce these technology trade controls more rigorously.  The challenge for companies operating and trading across borders is that the definitions, scope, procedural requirements, and implementation of strategic and other forms of technology trade controls likely differ from one foreign jurisdiction to the next.  This webinar is designed to help you meet those technology trade control challenges. 

This webinar has two main aims:

• provide an overview of global technology trade controls,
• offer strategies and practical tips for how to comply with them in an operationally efficient way. 

The webinar will cover technology trade controls as they pertain to various industry sectors, including the aerospace, automotive, biotechnology, defense, electronics, industrial equipment, IT, and software industries.  Technology trade controls in European, Asian, Middle Eastern, and Latin American countries will be discussed.  Specifically, this webinar will:

• Deliver a comprehensive overview of which countries in the world have strategic technology trade controls, and which are working to introduce them;

• Highlight recent changes and developments in global technology trade controls, including the application of trade controls to emerging technologies and enforcement trends;

• Reveal the differences and similarities in how “technology” and “export” are defined and scoped across different foreign export control systems (with comparisons to the U.S. export control system);

• Address the application of select countries’ export controls to hand-carries, cloud computing, and domestic transfers of strategic technology;

• Note some of the special licensing procedures and documentation requirements for “exports” of controlled technology from foreign jurisdictions; and,

• Share insights from real-world cases of technology trade controls and suggestions for how to enhance your technology trade compliance.

This webinar will provide PowerPoint slides and include live video and commentary from Jay Nash who specializes in non-U.S. trade controls and compliance. Mr. Nash has worked with national governments from every region of the world to provide guidance and support on establishing domestic export control systems and developing compliance tools and resources for industry.  Mr. Nash is a regular speaker and presenter at regional and international export control conferences and he has published on East Asian trade control developments in the U.S., Japan, and Korea. Webinar participants are invited to submit questions during the webinar; the final 30 minutes of the webinar will be allotted to answering attendees' questions.
