For many government contacts, the allocation of intellectual property rights is the most critical issue both parties will face.  In this 90 minute webinar, an experienced government procurement attorney will survey critical government contract intellectual property issues.  The course will address:

 

  • The different types of intellectual property, including differences between commercial and government contract IP
  • Technical data rights: how they are allocated between the government and contractors, and how contractors can maximize value
  • Computer software and documentation: allocation by license and by the FAR/DFAR clauses
  • Commercial computer software: EULA and standard commercial licenses
  • Patent rights, including Bayh-Dole provisions
  • Research vehicles: SBIRs/CRADAs/”Other transactions,” and beyond
  • Compliance issues in government contract IP: avoiding the False Claims Act and debarment
  • “Soft IP:” NDAs and other confidentiality provisions

Speaker and Presenter Information

William Weisberg

William Weisberg is a government contracts attorney with 30 years of experience. Bill received his undergraduate degree from the University of Virginia (where he was an Echols Scholar) in 1983 and his law degree from the George Washington University in 1986. Bill practiced with large international law firms for over 25 years, the last 10 of which he led his firms’ Government Contract and Grant practice groups. Bill formed his own boutique government contract firm in 2013.

 

Bill represents both traditional defense contractors as well as primarily commercial companies selling either directly to a government customer or selling into a government supply chain. Bill’s clients are found in many industries, including manufacturing, professional services, IT, construction, and a variety of high (and not so high) tech.
