MSPB Today: Changing Direction, Redefining Case Law



The MSPB continues to reshape case law as more favorable to employees. Several recent rulings will have a big impact – and if you’re not up to speed you risk having to defend an employment action in front of the Board!

 

In 90 fast-paced minutes, attorney, in-demand speaker – and former MSPB administrative judge – Sam Vitaro will outline the Board's key rulings from the past year, highlighting the areas that show how the change in direction is affecting federal employment law and explaining what it all means for the decisions you make every day.

 

You’ll hear how the MSPB is handling cases involving disability retirement, suitability, extended absence, whistleblower appeals, jurisdiction, settlement, nexus and more, plus learn about key Federal Circuit decisions. Mr. Vitaro will turn case law into valuable lessons including:

  • Spotting the factors that strengthen or weaken cases
  • Using the elements of specific adverse actions and those Douglas factors that lead to significant penalties
  • The role of “intent to discriminate” in claims under the Uniformed Services Employment and Reemployment Rights Act
  • The burden of proof necessary in appeals involving disability discrimination arising before the 2009 ADA Amendments

This event is an audio conference and can be accessed from the comfort of your office or conference room. Speaker and Presenter Information

Mr. Vitaro served as an administrative judge with the MSPB from 1982-1988. He also practiced law privately in Pittsburgh, Pa., and worked as a supervisory trial attorney with the EEOC. The author of several books, including MSPB Charges and Penalties (Dewey Publications) and It's More Than Sexual: Handling All Types of Harassment in the Federal Workplace (LRP Publications), Mr. Vitaro is currently a labor arbitrator/mediator/fact-finder in private practice. He also provides consulting services and participates as an expert witness in lawsuits involving discrimination or civil service law.
