"Determining Jurisdiction--The Right Way" Webinar

Get Your Jurisdiction Right, Or Else!

USML vs. CCL Jurisdiction Advanced Analysis

One of the most critical export compliance issues is determining whether a product or technology is subject to the jurisdiction of the US Munitions List or the Commerce Control List.  If you get that decision wrong, just about everything else you do related to exporting or reexporting the item will likely not comply with the applicable regulations.

The ITAR does not give companies the option to decide what they think jurisdiction should be based on. Logic, common sense or other judgments cannot be used when determining an item or technologies jurisdiction.  The ITAR lays out the specific rules for jurisdiction but they are some of the most misunderstood, overlooked, misused, and even ignored rules in the regulations.

We will examine these critical jurisdiction topics:

  • Applying the regulations, not folklore
  • Jurisdiction = What is a “defense article”
  • Rules for exporters to use when determining jurisdiction
  • Criteria the US Government follows to designate additional items
  • Analysis of specifically “designed or modified” vs. “usable,” “destined for use in,” “configured”
  • Ignoring non-regulatory terminology when making jurisdiction determinations
  • Jurisdiction special cases:  Learning how they apply and understanding the implications of where they do not apply
  • Finding company resources to help you in your jurisdiction determinations

Join ECTI and John Black for an in-depth and thorough examination of jurisdiction issues.  When you finish this webinar, you will have a sound understanding of the jurisdiction rules and the basis for a practical approach to making jurisdiction decisions that comply with the regulations.

"Determining Jurisdiction--The Right Way" Webinar will provide PowerPoint slides and include video and commentary from John Black who has been working in the export controls industry for 27 years.
