False Claims Act: Key Provisions and Current Trends in Compliance and Enforcement

The False Claims Act (“FCA”) is the government’s primary enforcement tool for combating fraud in connection with alleged false claims made for federal funds. Since the FCA was amended in 1986, more than $30 billion dollars has been recovered in damages, fines and penalties, impacting a wide array of industries including health care, mortgage financing, and government procurement. In addition to FCA violations being subject to treble damages and penalties of between $5,500 to $11,000 per claim, companies face the risk of suspension and debarment, and in some cases, criminal prosecution. Understanding the liability risks under the FCA and the current trends in enforcement is essential for ensuring compliance and mitigating exposure risks.

This 90-minute webinar will provide an overview of key FCA provisions to help you understand the risks, with practical examples and guidance that will equip you to identify and avoid potential FCA violations. Speaker and Presenter Information

Robert Rhoad is a partner with Crowell & Moring LLP in Washington, D.C. He is a member of the firm’s Government Contracts and Health Care practice groups and leads the firm’s Procurement Fraud/False Claims Act Team. Mr. Rhoad’s practice is focused on defending companies and corporate executives facing criminal and/or civil government enforcement actions under the federal False Claims Act (including qui tam “whistleblower” actions), state false claims laws, and other fraud and abuse provisions. His record of success in False Claims Act cases includes resolving such matters at the investigation stage, through litigation, and, when necessary, through trial and on appeal. Prior to joining Crowell & Moring in 2007, Mr. Rhoad spent nine years at a national law firm where he led its False Claims Act practice and, prior to that, he served for nearly six years as a government attorney with the Navy Judge Advocate General’s (“JAG”) Corps. In addition to his active False Claims Act practice, he has presented at numerous conferences and authored various articles on the False Claims Act and other areas related to fraud enforcement. Since 2002, he has taught litigation courses as an Adjunct Professor at The George Washington University Law School. Dalal Hasan is an associate in Crowell & Moring’s Washington, DC office. She practices in the White Collar & Regulatory Enforcement and Government Contracts Groups. Her practice involves representation of corporate and individual clients in all phases of criminal and civil matters, including internal investigations, compliance counseling, suspension and debarment matters, federal grand jury investigations, False Claims Act litigation and other complex civil litigation and criminal proceedings. Prior to joining Crowell & Moring, Dalal worked at a major U.S. non-governmental organization managing federal grants programs in the Middle East and North Africa. She is proficient in Arabic and has extensive travel and professional experience in the region. Dalal received her undergraduate degree from Georgetown University, where she studied International Politics, with a focus on Middle East Studies, and an M.A. in International Affairs and Economics from the Johns Hopkins School of International Studies in 2004. She received her J.D. from Georgetown University Law Center in 2010, where she served on the Georgetown Immigration Law Journal.
