CBP Prior Disclosure: Mitigating Importer Liability

MAY 11, 2023 | 10:30 a.m. EDT

Filing prior disclosures to Customs and Border Protection (CBP) is a critical tool that importers can deploy when and if violations of import regulations are discovered. Material errors and omissions can occur despite an importer’s best efforts to be compliant.

When used properly, a disclosure may significantly reduce penalty exposure and demonstrate reasonable care. During this webinar, we will review the considerations, risks, benefits, steps, and critical elements needed to file a valid prior disclosure.

The webinar discussion will:

  • Identify CBP enforcement priorities such as classification, valuation, antidumping/countervailing duties, trade remedies, forced labor, etc.
  • Review the 19 U.S.C. 1592 statute, levels of culpability, and potential penalty mitigation possibilities
  • Outline the procedural elements, contents, and formatting of a disclosure letter
  • Describe considerations such as calculation of amount owing, sampling methodologies, offsetting of overpayments, statute of limitation waivers, and timing constraints

This webinar is ideal for executives, compliance directors and managers, and customs brokers who want to discover what is involved in filing a prior disclosure with CBP.
