Encryption Export Controls

U.S. export controls on hardware and software using encryption remain one of the areas that can confound even the most experienced export compliance practitioner. This webinar will go through the basics of classifying items that could fall within Category 5 Part II of the Commerce Control List. We will also review export licensing requirements for these items, including NLR and License Exception ENC. Designed for individuals with a working knowledge of the export regulations.

  • General discussion of the present controls on commercial encryption technology
  • Review of technical basics and the terminology used in the Cat. 5 Part II Technical Note regarding “cryptography for data confidentiality”
  • Review of classification methodologies for items where information security is not the primary purpose
  • The use of publicly available encryption code in creating software for commercial sale
  • Understanding licensing authorities: NLR, ENC, and Export Licenses for products using encryption
  • Recordkeeping and reporting requirements
  • Outlook for future regulatory changes

Speaker and Presenter Information

Felice Laird has over 25 years of experience helping companies comply with the U.S. Export Administration and International Traffic in Arms Regulations. Her work involves assisting companies and outside counsel with jurisdiction, classification, and licensing decisions to ensure compliance with U.S. trade regulations. She is a recognized subject matter expert in encryption export controls and has decades of experience helping both large and small firms navigate the complex export restrictions on data security technologies, telecommunications equipment and software, and semiconductors. As the U.S. Government has increased its authority in overseeing foreign investment in the United States, Felice has been a resource to the legal community on technical matters in the context of M&A and in-bound foreign investments. In addition to consulting work, Felice provides training to the community designed to make practitioners self-sufficient in understanding and interpreting U.S. Government regulations.
