Taking Disciplinary or Performance-Based Action Against Federal Employees With Medical Issues



Agency management is often hesitant to take adverse action toward employees who have a disability or a medical issue, fearful of triggering discrimination claims. But that doesn’t mean you shouldn’t – or can’t – discipline those employees for misconduct or take action for performance problems when it’s warranted.

Speaker and Presenter Information

Marilyn Mattingly specializes in human resources management consulting and training in labor and employee relations issues. A former federal labor and employee relations specialist for the Department of the Navy, she is experienced in collective bargaining and in representation work before the Federal Service Impasses Panel, the Federal Labor Relations Authority, the Merit Systems Protection Board, the Equal Employment Opportunity Commission, and in arbitration. She is a frequent presenter of LRP audio conferences and speaker at national conferences, particularly on leave and medical issues. She is the author of several books, including Watch Your Step, 13 Mistakes Agencies Make in the Disciplinary Process and How to Avoid Them and Insubordination in the Federal Workplace: What It Is, Why It Happens, How to Respond, both published by LRP Publications.
