Elements of Offenses: Proving Your Agency's Disciplinary Action

An employee sees a colleague swipe some agency items for personal use.
Theft, misuse of government property or unauthorized possession?

A male employee regularly presents a female colleague with flowers.
Sexual harassment, conduct unbecoming, inappropriate conduct, or just innocent wooing?

An employee falsifies his expense reimbursement claims.
Falsification, lack of candor, or another example of a typical fed?

Which charge will stand up to MSPB review? Find out from Barbara Haga, a federal HR professional for more than 20 years, with extensive experience advising on, preparing and defending disciplinary actions.

By using examples of misconduct, Ms. Haga will walk you through the process of determining what elements need to be proven to substantiate specific charges and how to draft penalties that fit the evidence you've been presented.

Falsification. Theft. Insubordination. Unacceptable performance. Misuse of government property. Excessive absence … You’ll learn what the most common charges entail, so actions are handled properly from pre-action investigation through third-party review. Plus you’ll learn:

  • How to properly analyze misconduct
  • The importance of evaluating evidence before you construct a charge
  • How to avoid common pitfalls, including which words can cause you to have to prove more than you intended
  • Which offenses include intent and the requirements of establishing intent
  • How to advise managers early in the process of initiating and preparing disciplinary actions

And, Q&A breaks give you the opportunity to ask Ms. Haga your specific questions!
