MSPB Rules Revamped … Now What? Broida Breaks It All Down

After more than 30 years, the MSPB regulations received a long-overdue overhaul – and the new rules require your agency to change procedures effective November 13.

Learn what you need to know about the new rules directly from Peter Broida, a key stakeholder in the MSPB process who provided input and recommendations for the new regulations. Mr. Broida will walk you through an analysis of the changes using MSPB’s chart to illustrate key points and explaining how the new rules:

  • Change board jurisdiction over individual right of action appeals
  • Specify the scope of “relevant documents”
  • Clarify the MSPB's jurisdiction over suitability actions
  • Give AJs the explicit authority to suspend or terminate a hearing already under way
  • Add new language to reflect the MSPB's current e-filing policy
  • Simplify third-party discovery procedures
  • Allow replies to responses to petitions for review

Plus, you’ll learn how to follow the changes to the rules as you handle appeals, including how to:

  • Make agency notices compliant with the new regulations
  • File compliant petitions and cross petitions for review, and reply to responses to petitions for review
  • Understand the revisions in discovery processes
  • Utilize due process procedures for belated evidentiary submissions
  • Navigate the changes to the sanctions provisions
  • Recognize the changes in the processing of enforcement petitions involving Board decisions and Board-accepted settlements
  • Recognizes the election of remedies requirements pertaining to whistleblower appeals and defenses

Q&A breaks will give you the opportunity to ask Mr. Broida your questions!
